Terms and Conditions (T&C)

  1. Subject Matter of the Contract
    Klaus Fuchs Communication provides, in particular, the following services: website conception and design
  2. Scope of Application
    These Terms and Conditions ("T&C") apply to all services provided by Klaus Fuchs Communication in the fields of web design, website maintenance, consulting and digital communication.Any deviating agreements must be made in writing.
    • technical implementation and programming
    • maintenance and support of existing websites
    • backup and monitoring services
    • hosting consultancy
    • technical support and training
    • The exact scope of services is defined in the respective quotation or individual agreement.
  3. Fees and Payment Terms
    Unless otherwise agreed, invoicing shall be carried out in accordance with the respective quotation.
    Support and maintenance contracts are concluded for a period of six months and are invoiced in advance.
    Additional services exceeding the agreed scope of work shall be charged separately at the applicable hourly rate.
  4. Support and Maintenance
    The support fee covers the services described in the respective maintenance agreement.
    Additional work shall only be carried out upon prior agreement.
  5. Software Licences
    Third-party software products and extensions may be used for the operation of the website.
    Klaus Fuchs Communication uses, in some cases, multi-site licences, the costs of which are proportionally included in the respective maintenance services.
    All licences remain the property of Klaus Fuchs Communication or the respective software vendor and may not be transferred to third parties.
  6. Customer Obligations
    The customer undertakes to provide all information, content and access credentials required for the execution of the project in a timely manner.
    Delays caused by missing information or insufficient cooperation on the part of the customer shall result in a corresponding extension of any agreed deadlines.
  7. Liability
    Klaus Fuchs Communication shall only be liable for damages caused intentionally or through gross negligence.
    Liability for failures of hosting providers, third-party providers or external services is excluded to the extent permitted by law.
    Despite regular backups, no guarantee can be given for the complete restoration of all data.
  8. Termination
    Support and maintenance contracts may be terminated with four weeks' notice prior to the end of the respective contract period.
    The right to extraordinary termination for good cause shall remain unaffected.
  9. Governing Law and Jurisdiction
    Klaus Fuchs Communication operates from Malaysia.
    All contractual relationships shall be governed by the laws of Malaysia, unless mandatory legal provisions of the customer's country of residence provide otherwise. To the extent permitted by law, the place of jurisdiction for all disputes arising from the business relationship shall be Selangor, Malaysia.
  10. Contract Documents
    Contract documents may be provided in both German and English.
    In the event of discrepancies or differing interpretations, the German version shall prevail.
  11. Invoicing
    All prices quoted are final prices.
    Klaus Fuchs Communication is not subject to German value-added tax (VAT); therefore, no German VAT is charged or shown on invoices.
  12. Final Provisions
    Should any provision of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
  13. Copyright and Rights of Use
    All concepts, designs, graphics, software code and other work results created by Klaus Fuchs Communication are protected by copyright.
    Upon full payment, the customer shall receive a non-exclusive, unlimited right to use the delivered work for the agreed purposes.
    Any transfer, reproduction or resale to third parties is only permitted with the express written consent of Klaus Fuchs Communication.
    This does not apply to content provided by the customer.
  14. Customer-Provided Content
    The customer warrants that all texts, images, videos and other materials provided are free from third-party rights or that the necessary rights of use have been obtained.
    The customer shall indemnify and hold Klaus Fuchs Communication harmless from any third-party claims arising from infringements of copyright, trademark rights or personal rights.
  15. Open-Source Software and Third-Party Services
    The website may contain open-source software as well as components and services provided by third parties.
    Klaus Fuchs Communication shall not be liable for changes to licence terms, price adjustments or the discontinuation of such products or services.
  16. End of Cooperation
    Upon termination of the cooperation, all multi-site licences, maintenance tools, backup systems and other infrastructure provided by Klaus Fuchs Communication shall remain the property of Klaus Fuchs Communication.

    Upon request, the customer shall receive all content provided by the customer as well as the completed website in its current state at the time of termination of the contractual relationship.
